Abschnitt IV: Verfahren
- Dringende Gründe im Zusammenhang mit für den öffentlichen Auftraggeber unvorhersehbaren Ereignissen, die den strengen Bedingungen der Richtlinie genügen
VIVID need to comply with the latest Government advice in order to provide the highest level of fire safety for its customers. we have surveyed all of our tall buildings and need to complete replacement cladding designs and programmes of work to remediate all issues identified, immediately upon receipt of advice from Government.
Ministry of Housing, Communities and Local Government (MHCLG) Advice note 22 released in July 2019 provided further advice to landlords to remove high pressure laminate cladding systems with polyisocyanurate insulation within them. We had to confirm how the cladding panels would perform under a calorific value test and also carry out a façade fire risk assessment. This confirmed that the panels had a Class B rating or worse. Other issues with the insulation and compartmentation were discovered during the intrusive inspections.
The latest government ‘Advice Note for Building Owners of Multi-storey, Multi-occupied Residential Buildings’ released in January 2020, consolidates all previous advice and reaffirms our position. Consequently, VIVID requires the engagement of a consultant with cladding engineering expertise to design and specify a replacement cladding system which will be non-combustible within. We are seeking to award this contract without prior publication of a call for competition in the OJEU, in order to tender the works as soon as possible. There is extreme urgency in the requirement to improve fire safety on cladding systems; and in this case, the specific results of testing instigated by the MHCLG advice note 22 were not foreseen. This therefore meets the requirements set out under Article 32 of Directive 2014/24/EU.
